Unlawful flight
Title 18, United States Code, 1073 “Whoever moves in interstate or foreign commerce with intent either to avoid prosecution, or custody or confinement after conviction under the laws of the place from which he flees for a crime or an attempt to commit a crime, punishable by death or which is a felony under the laws of the place from which the fugitive flees, etc., shall be fined under this title or imprisoned not more than five years or both.”
This statute is another bread and butter type matter for which the Federal Bureau of Investigation is well identified with for its enforcement. Usually, in large offices of the FBI, agents assigned to the violent crime matters address these types of investigations.
While assigned to the Bangor, Maine, office, several fugitives were arrested from out of state who were wanted in those states for crimes ranging from grand larceny to murder.
Local fugitives such as Whitey Bulger, Michael Salvatore Caruana, Roderick Hotham, and Ellwyn Cook will be forever watching their backsides due to the broad provisions of this statute. Bulger is from the Boston, Massachusetts area and currently is an FBI Top Ten Fugitive. There is a $5 million reward for his apprehension. Caruana formerly resided in greater Boston and conducted his illegal narcotics distribution network in the northeast, primarily in the Dexter, Maine area. Roderick Hotham is a well-known Bangor, Maine fugitive who bilked the Durham Bank and Trust in Durham, New Hampshire of $3 million. Ellwyn Cook is a Mohawk (Native American) fugitive from justice arising out of the Francis Boots’ bribery and tobacco smuggling scheme in 1992. This investigation was conducted in Eastport, Maine.

The Unlawful Flight statute is also used to track down and arrest the non-custodial parent or guardian of a minor child who may have absconded with the child into another state in violation of a local child custody court order. Typically, a local police officer or detective makes a request through the local FBI office for a UFAP warrant if all of the following requirements are met: (1) a local judge issued a felony warrant for the apprehension of the parent or guardian. This warrant is generally issued for violating a court order as a result of a custodial ruling against the one who left the state with the minor. (2) Evidence of interstate travel would have to be established by the local police officer or detective. (3) A written request from an appropriate state authority requesting federal assistance. Usually, this letter is from the District Attorney’s office. (4) The requesting authorities would have to commit to extraditing the perpetrator when found and repatriate the victim with his lawful custodian.
The UFAP investigation can be used in several other similar matters. All in all, it is an excellent law enforcement tool.

If I wanted a quick $5 million, I’d call the FBI and they’d find Whitey with no problem. Unlike Robert who forwarded poor ol Fred’s post to the Attorney General the other day, I’m not going to do that. Besides, what would I do with $5 million anyway? After Uncle Sam got done taking taxes out and all that other good stuff, I wouldn’t have a whole lot left anyway.

I can do without money or fame. Though I admit, I’d be happy to report the story to wide-eyed readers. It’s more about justice. We’d be in pretty bad shape if everybody opted to keep crucial information to themselves. Heroes are those who do what is uncomfortable, unnatural, and often unimaginable.

Rod Hotham took no money from Durham Bank & Trust in Durham, NH. The allegations against him were concerning a money transfer he made when he was in the process of buying the bank.
There is more evidence to show that he was murdered for what he knew than there ever was for anything he allegedly did wrong.
We know who killed Rod and why he was killed.
What a slanderous remark you have made against an innocent man. Who’s feeding you your information?
You are right about Rod not being forgotten. In the pursuit for justice, the day will come when the truth will be known.

He absolutely tried to steal 2.5 million from the bank. He was sued by the bank and the money returned within a business day of its theft.

What you are saying does not make sense and is not true. I hope someday to be able to hold you accountable for what you have said.
He was transferring money INTO the bank from outside sources to purchase the bank, as you well know. The bank was already troubled and under an FDIC cease and desist order when Rod was given the opportunity to purchase it.
As the conservator of his estate, I should have seen a copy of this alleged lawsuit.
Rod did not try to steal any money. This is an intent issue. It is obvious from his actions and the details surrounding this situation that Rod never intended to defraud anybody.

I am truly sorry if I have made you uncomfortable and I am not sure what you meant by saying, “Feel free to add me to your lawsuit any day you want” nor do I understand why you would fear me. I have only responded to false statements that have been made against my brother. He did not bilk Durham Bank of 3 million dollars nor did he try to steal 2.5 million dollars from that bank as the statements in the article “Unlawful Flight” and the response from X-President Durham Bank have said. Rod was a good man that stepped into something that got him killed.
Rod was eight years older than me and our family was poor. As a teenager, he would buy me clothes with the money he made picking potatoes. He started working at the age of 12 and never quit. My mom tells the story of him falling asleep in the bathtub after picking potatoes all day and how he still wanted to go to his job at the grocery store that night. He worked his way through college and bought his first suit at the Blue Light Special for his first job interview. He excelled and succeeded at what he did.
I don’t know who the guy is that you’re painting a picture of, but it’s not Rod Hotham.
Rod was not even indicted until after his disappearance and I feel that it was my fault because of how I publicly fought for him. Rod had no reason to run as he proved by his actions in the time previous to his disappearance. I have felt for a very long time that Rod was killed because of information that he was scheduled to deliver to the State Attorney General’s office on the day of his disappearance.
In the fall of 2002, my mother received a call from a man who claimed to know who killed her son. As I developed the information he gave our family, the story unfolded. Rod was killed on September 16, 1992. His body was stuffed under a tree in the Maine woods by a skidder. The State Police brought cadaver dogs to look for the body, but after so many years – nothing.
If you objectively study this case, you will see that the charges against Rod are lame and that there is way more to this story.

I was thinking about him today, and all the things wonderful things he did for me, so I decided to google his name and this post came up. I was shocked to see the comments made about Rod Hotham and appreciate there was one person who knows the truth. Thank goodness Rod had a brother that has kept the fight for justice going. I hope that someday the truth will be uncovered and the people be brought to justice who took away his life. Rod has three beautiful children who are missing their father. I call them children because when he was murdered they were. Now they are young adults. Bless you all who have fought to have the truth revealed.
LaFlamme, you may have a wonderful opportunity to help keep this cold case in the minds of investigators. As a journalist it wouldn’t take you very long to look at the evidence against Rod and know how false it is. It would be a great thing for you to contribute to. Why don’t you look at the FBI’s evidence of Rod’s guilt? The charges against Rod are ridiculous. Is that why they never indicted him until two months after he disappeared? A child could defend Rod against these charges in a court of law. Our government has shown time and time again that they will misuse their power and authority to demonize innocent people to cover up wrong doing.
And as far as producing evidence of Rod’s murder, let’s start with the FBI unsealing all the information related to the Franklin Cover-up and politicians being compromised by the government. Then, ask Mike Carpenter, the Maine State Attorney General at the time of Rod’s disappearance, what he was expecting Rod to bring him on the day Rod disappeared. And also, you can ask Ken McMasters of the Maine State Police what evidence prompted him to bring a cadaver dog into the Maine woods to look for Rod’s body. As you will find, Mr. Goulet, there is plenty of evidence proving Rod’s innocence and why someone would want him dead.
What evidence can YOU provide that shows who Rod was “hanging out with and working for in 1992?”
I found your behavior, as an officer of the law, unacceptable when you came to Rod’s hometown all those years ago to try and convince people of his guilt. Remember, I caught you in my lawyer’s office spreading your lies and I threw you out? I now find your comments unacceptable and inflammatory. Rod is innocent until proven guilty. You have NO evidence to back up your remarks and in fact are spreading more lies when you suggest that we would know where Rod is!
From your own admission of mental illness and alcohol dependency (http://serveandprotect.wordpress.com/2007/01/05/meet-don-goulet/), it makes me wonder in the soundness of your judgement. Are YOU compromised Mr. Goulet? Is that why you, as a retired FBI agent, insist on trying to convince people of something that is clearly not true? How is it that you can so boldly spread your lies? Who is Don Goulet hanging out with and working for?
Will someone please take a good, long, honest, objective look at this case? The law enforcement agencies that are in place to protect the public and provide truth and justice are using their resources to cover up the facts of this case. The only way you could think Rod is guilty is if you’re an incredibly gullible person. With a small amount of research, you can see for yourself that the allegations against Rod are not true and that there is way more to this story. It doesn’t take a rocket scientist to see that the institutions that made this country great are in serious trouble.
My brother, Rod Hotham, was a man of integrity who loved his family. His life and actions are above reproach.

Yes, Rod was married with children ages 12, 10, and 6 at the time of his disappearance. I am proud of his family for as well as they have done under the circumstances. They lost their husband, father, and support. What that family has gone through since Rod was taken is heart wrenching for me to ponder.
There are those that blame Rod for leaving his family because they subscribe to the notion that he took something and ran. Rod took nothing, nor did he run. The facts and evidence are clear. I would love to believe that Rod is with his family living happily ever after. The sad reality is that Rod is gone and his family has never recovered from the devastation that our corrupt government and its apathetic, ill-informed citizens have heaped upon them.
I know who is behind Rod’s disappearance and death. I will never blame his wife for wanting a new beginning.
The research is done – so why is the truth still hidden? If people don’t see the corruption within our government by now, they have become part of the problem. Our forefathers warned us that our apathy would be our downfall. What happened to Rod and his family is a symptom of a bigger problem that now plagues our country. No one will be able to blame Rod Hotham for not trying to expose the corrupt forces that are destroying America.

I just want to say that this conversation about Rod Hotham really interests and shocks me as I was under the impression that Hotham was never quite found and that to anyone’s knowledge, he was still alive. My father always told me that he fled from the country and was now probably in South America. If you want to know more about what position I am in, look up Stucco Lodge and its relation to Rod Hotham. I would really love any more info on Rod Hotham, as I can’t really find anything anywhere else. Although, I have one source none of you may know about, I don’t mind saying it. I am unaware of any meeting between Rod and a state trooper named George Mitchell.
I think you mean Dennis R. McLellan the Maine State Police Detective who offered to give Rod a ride to Augusta for his scheduled appointment with the Maine Attorney General and refused to answer questions at a Probate Court hearing about Rod Hotham’s dissappearance. The statements that this detective made the night of Rod’s dissapearance and the following morning show that he knew details that would not only prove that Rod did not leave on his own but would shead alot of light on why someone went to all the trouble to bring bogus federal charges against Rod nearly two months after he dissappeared.

Very interesting.
After giving this some thought I do vaguely remember this but never was able to give it much attention considering how young and naïve I was and how I was being inundated with information from the many facets of this case.
Let’s not forget that Rod’s troubles started when his accounting firm was hired to audit the books of the Penobscot Indians because they felt they were being taken advantage of. His investigation took him to the Cayman Islands and we all know what that means.
I do not doubt that this gentleman could have played some kind of role in Rod’s disappearance. This is just another example in a long list of facts that are being ignored by law enforcement. There is so much credible information that has not been investigated by any authority that if it had been, this case could have been closed long ago.
What is the exact subject of your thesis?

Rod’s brother, my thesis is on the land claims settlement act of 1980, and other aspects that have affected native people in maine. I have interviewed many prominent people involved in the settlement act. I am hoping to have president carter come to UMaine next nov on the 30th anniversy of the signing of the act. I know you have spoken with my cousin richard on this subject. I am from the county and travel up there about once every two weeks. Maybe we could get togethor and shareour info ? Regards, David
